According to Tennessee state law, school personnel may file a juvenile petition against a student receiving exceptional education services. Such filing can be done only after conducting a manifestation determination. This determination must show that the behavior that resulted in the act requiring disciplinary action was not caused by the student’s disability. A truancy petition falls into the category of juvenile petition. Therefore, before a truancy petition (juvenile petition) is filed on behalf of a student receiving exceptional education services, a manifestation determination meeting must be held to consider whether or not the student’s truant behavior is related to his/her disability.
